Terms of Service
Welcome to Jacta! These Terms of Service ("Terms") govern your use of the Jacta mobile application ("App") operated by Zap Software ("Company", "we", "us", or "our").
By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our App.
1. Use of the App
1.1 Eligibility
You must be at least 13 years of age to use Jacta. If you are under 18, you must have parental or guardian consent to use the App.
1.2 Account Registration
To access certain features, you may need to create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
1.3 Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use automated systems to access the App without permission
- Transmit any malware, viruses, or harmful code
2. Subscriptions and Payments
2.1 Premium Features
Jacta offers premium subscription plans that provide access to additional features. Subscription details, including pricing and features, are displayed within the App.
2.2 Billing
Subscriptions are billed through your Apple App Store or Google Play Store account. Payment will be charged to your account upon confirmation of purchase.
2.3 Automatic Renewal
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.
2.4 Refunds
Refund requests are handled by Apple or Google according to their respective policies. We do not directly process refunds for app store purchases.
3. User Content
3.1 Your Data
You retain ownership of any data you enter into Jacta, including study logs, notes, and personal information. By using the App, you grant us a limited license to store and process this data to provide our services.
3.2 Data Accuracy
You are responsible for the accuracy of the data you enter. We are not responsible for any consequences arising from inaccurate data entry.
4. Intellectual Property
4.1 Our Rights
The App, including its design, features, content, and underlying technology, is owned by Zap Software and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.
4.2 Trademarks
"Jacta" and associated logos are trademarks of Zap Software. You may not use these marks without our prior written permission.
5. Disclaimers
5.1 "As Is" Basis
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 No Guarantee of Results
Jacta is a tool to help you track your language learning progress. We do not guarantee that using the App will result in language proficiency or any specific learning outcomes.
5.3 Service Availability
We do not guarantee that the App will be available at all times. We may suspend or discontinue the App or any feature at any time without notice.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Zap Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the App.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 CAD, whichever is greater.
7. Indemnification
You agree to indemnify and hold harmless Zap Software, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
8. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
9. Termination
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination will survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Ontario, Canada.
